1.1 In accordance with the following Terms & Conditions (hereinafter called the “Rules”) the Trading Battle is organized by SimpleFX, registration number 22361 BC 2014 with its seat in Beachmont Business Centre, Suite 404, Kingstown St. Vincent and the Grenadines (hereinafter called the “Organizer”).
1.2 By applying for the participation, you (“you” or “your”), acknowledge that you have read and understood the Rules, T&Cs, Privacy Policy and agreed to be bound by them. To ensure participation in the Trading Battle, any personal data of the Trading Battle participants is processed under our Privacy Policy.
1.3 The Trading Battle is held on the territory of all countries, except for the Excluded Territories and any countries where skill-based tournaments are prohibited by law.

2.1 Eligibility. All Participants must be duly registered and shall comply with the following:
2.1.1 Must be natural persons.
2.1.2 Shall be at least 18 years of age.
2.1.3 Have an internet connection.
2.1.4 Create one Contest trading account.
2.2 The Winners who are not yet 18 years of age by the time they register are excluded from participating. Trading Battle administration reserves the right to check that Participants are not underage.
2.3 Registration. Participants have the right to create only one Contest trading account, in case a person has made several accounts only the first account accepted by the Organizer will be valid.
2.4 Contest trading accounts should be opened with the same email address that Participants used for buying tickets for the NextBlockExpo.
2.5 The verification link in the email is only valid for 24 hours. If more than 24 hours has passed, sign up shall be done again.

3.1 Trading Battle period: from 08:00 am on the 4th of December until 16:30 5th of December.
3.2 Each Participant may use Warm-up before the official Trading Battle starts.
3.3 The Warm-up account will be used as a Contest account for Participants that registered before the start of the Event.
3.4 Warm-up account score is reset before the start of the Event not later than the 08:00 on the 4th of December.
3.5 Participants with the top 3 highest Scores will be rewarded with money prizes.
3.6 Prizes are allocated as follows:
3.6.1 10000 euro for first place,
3.6.2 3500 euro for second,
3.6.3 1500 euro for 3rd place.
3.7 Only Participants who acquired tickets for the entire NBX event are eligible to be Winners.
3.8 Scores of Participants will be displayed on the dashboard.
3.9 Dashboard shows at least 10 Participants who generated the highest Score at the moment.
3.10 Scores are shown live.
3.11 The Award Ceremony starts at 17:15 on the main stage - Hall 9, located on the 4th Floor at CineStar Cubix Rathausstraße 1, 10178 Berlin, Germany.

4.1 The maximum number of winners is 3.
4.2 The Winners must be verified by a short message sent to the email they used for registration of the Contest trading account.
4.3 In the event of absence of any Winner at the award ceremony or any other reason that the Winner is not able/allowed to receive the Prize, the next person who generated the highest rate of return is promoted to the position of the absent Winner.
4.4 The Winner who was promoted due to the absence of another Winner does not retain money from his previous position in the ranking.
4.5 The Organizer retains the right to award the Winner with the equivalent of the Prizes, which are defined in p. 3.6., in a form of currency convenient to the Organizer. Detailed instructions regarding the payment method will be provided to the Winner via the email address provided during registration.
4.6 The exchange rates in case of payment in another currency is determined by the SimpleFX system at the conclusion of the day prior to the day of the award ceremony.
4.7 The Prize may be withdrawn or used for further trading on the SimpleFX live account.
4.8 Withdrawal of the reward is accepted once the winner of the 1st place generates 15 lots of turnover of the base currency, the winner of 2nd place generates 5 lots of turnover of the base currency, the winner of the 3rd place generates 1,5 lot of turnover of the base currency on their SimpleFX live accounts.
4.9 The Winners receive the prize free of charge. The prize cannot be replaced. The winner of the Trading Battle has no right to demand any other compensation from the Organizer.
4.10 The Winners determined by the Trading Battle results cannot transfer the rights to receive the Prize to third parties.
4.11 The Winner of the Trading Battle can refuse to receive the Prize.
4.12 The Organizer does not compensate for additional expenses of the Winner related to the receipt of the Prize. The Winners who receive the prize shall pay all necessary taxes at their own expense.
4.13 Winners may only be rewarded after their ID is checked during the award ceremony.

5.1 The Trading Battle is not a game of chance, a lottery, a service in the field of gambling business. The Trading Battle is a game of skill, which depends on the Participant’s knowledge, technical analysis, skills, etc., and eliminates any odds. These Terms are not a public promise of reward.
5.2 By joining the Trading Battle, Participants agree to protect and hold harmless the Organizer and all involved entities from any liability, including claims, damages, injuries, or losses. Participants waive the right to bring claims related to:
5.2.1 Participation in the Trading Battle.
5.2.2 Prize acceptance, possession, or use, including any resulting harm or damage.
5.2.3 Defamation, privacy violations, or intellectual property disputes.
5.2.4 Unauthorized interference or technical issues.
5.2.5 Administrative errors or postal issues.
5.2.6 Any injury or damage, including to devices.
5.2.7 Disqualifying from the Trading battle in case of breach.
5.3 This indemnification applies to all aspects of Participation in the Trading Battle.
5.4 Disclaimers. The Organizer disclaims all liability, maximum permitted by the applicable law, in any case the aggregated amount of the total liability shall not exceed the price paid by the Participant to participate in Trading Battle.
5.5 By participating in this Trading Battle, Participants acknowledge and agree that any services provided and Prizes awarded are provided as-is, without any warranty or guarantee of any kind, including but not limited to warranties of merchantability, suitability, or fitness for a specific use.
5.6 Participants understand that their participation in this Trading Battle is voluntary and that any expectations regarding Prizes or outcomes are solely at their own discretion and risk. The Organizer does not make any representations or assurances regarding the nature, quality, or suitability of the Prizes for any specific purpose.
5.7 This disclaimer applies to all aspects of the Trading Battle, including but not limited to the selection of winners, the nature of Prizes awarded, and any potential discrepancies between expectations and actual outcomes.
5.8 The Organizer is not a financial advisor and outcomes, strategies, etc., in the simulator can not be extrapolated to real life, any virtual pairs of currency used will not guarantee you the same outcomes in real trading. You can not withdraw anything after the Trading Battle end session as there is no real money involved.
5.9 The Organizer does not provide legal or tax advisory services. Participants should be aware that they are solely responsible for any tax payments, reporting requirements, or other legal obligations that may arise as a result of winning the Prize, in accordance with the applicable laws.
5.10 Оrganizer reserves the right to terminate the competition at any time.
5.11 No risk involved, competition is for educational and fun purposes.
5.12 Participant Representations and Warranties: By participating, participants affirm their agreement with these terms and further warrant the following:
5.12.1 They meet all eligibility criteria outlined in these terms and are of legal age to participate in the Trading Battle in their jurisdiction.
5.12.2 their involvement in this Trading Battle does not constitute an endorsement or solicitation of any kind to engage with the Organizer’s platform for real cryptocurrency trading. They acknowledge that this Trading Battle is designed solely for entertainment and skill presentation purposes.
5.12.3 any virtual funds earned within the simulator, including but not limited to virtual money or assets, are non-transferable and cannot be withdrawn as real currency. These virtual funds are solely for use within the confines of the Trading Battle for fun and skill demonstration.
5.12.4 they will refrain from engaging in any prohibited activities within the virtual trading platform, refrain from actions that could manipulate outcomes, and commit not to disrupt the normal operation of the platform in any manner.
5.13 Participants may be disqualified from the Trading Battle in the event of any breach of the applicable terms and conditions.
5.14 The Organizer is not responsible for any problems or technical malfunction of any broadband telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any e-mail or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any website, or any combination thereof, including any injury or damage to a Participant’s or any other person’s computer or mobile telephone related to or resulting from participation or downloading any materials in relation to the Trading Battle.

6.1 We may make modifications (by amendment, replacement, and/or adding new provisions) to these Rules, the modified version of these Rules will be effective immediately when posted on the website https://simplefx.com/lp/trading-battle/ or, until the Trading Battle is implemented on SimpleFX trading platform, when a new version is brought to the participants' attention via agreed means of communication, including the integrations' functionality. You are responsible to check the website regularly for modifications to these Terms. Your continued participation in the Trading Battle after the effective date of a modification to these Terms will be conclusive proof that you agree to be bound by the modified version of these Terms.
6.2 By participating in the Trading Battle, Participants consent granting the Organizer and NBX Sp. z o.o. the right to publish and/or broadcast the results of the Trading Battle and disclose and publish Participants information as may be relevant and/or necessary for the fulfillment of the Prize.
6.3 By participating in the Trading Battle Participants consent granting the Organizer and NBX Sp. z o.o. the right to publish their image on social media, and websites.
6.4 When time is mentioned in these Terms of use, it means time according to the Central European Time zone.
6.5 Notices. We may provide notices regarding us, Trading Battle, and/or the Services by posting a notice on the SimpleFX website, and such notices will be effective when posted on the SimpleFX website. We may also provide any notice to you regarding or pursuant to these Terms by emailing a message to the email address associated with your Contest trading account. You are solely responsible for ensuring that the email account associated with your Contest trading account is accurate and current, and you agree that any notice sent by email to such email address will be effective when sent, whether or not you actually receive the email. To give us a notice regarding these Terms, or your Contest trading account, you must provide the notice by emailing a message to our support team at support@simplefx.com. Any such notice will be deemed effective 3 business days after it was received.

7.1 “Participant” means each person that joined the event by the contest version of SimpleFX trading account.
7.2 “Contest trading account” means a special version of SimpleFX trading account created for the purpose of Trading Battle with the email address that was not used before the time of the event for the registration on the SimpleFX website.
7.3 “Excluded Territories” means Afghanistan, Albania, Amazonia, American Samoa, Barbados, Belarus, Botswana, Burkina Faso, Cayman Island, Democratic Republic of Congo, Georgia (temporarily occupied territories), Gibraltar, Guam, Iran, Iraq (temporarily occupied territories), Jordan, Jamaica, Kosovo, Libya, Mall, Mozambique, Myanmar, Nagorno-Karabakh, Northern Cyprus, Northern Mariana Islands, North Korea, Nigeria, Pakistan, Palestine, Panama, Philippines, Puerto Rico, Republic of Moldova (Transnistria), Russian Federation, Saint Vincent & Grenadines, Senegal, Somalia, South Sudan, Spain, Sudan, Syria, Tanzania, Uganda, Ukraine (temporarily occupied territories), United Arab Emirates, United States of America, US Virgin Islands, Yemen, and Western Sahara.
7.4 “Warm-up account” means Contest trading account before the start of the Event.
7.5 “Score” means Rate of return generated by Participants.
7.6 “Rate of return” is calculated as a relation between the Contest account equity and sum of initial and extra deposits minus 1 [Equity/(Initial balance+Extra deposits) - 1].
7.7 “Winners” means Participants who generated the top 3 highest Rates of returns.
7.8 “Warm-up” means the period before the official start of the Event when Participants can trade on a warm-up account.
7.9 “Award ceremony” means the final moment of the Event, when Winners are awarded with Prizes.
